We are keen to help at an early stage of the construction process, whether you are the Employer or the Contractor. At this stage, you can best identify and manage the risks that are inevitable in a construction contract.
We regularly assist Employers in drafting tender documents and AF components, and we know from experience that the more transparent the contract documents are, the better the price and result you will obtain. The focal point should be to regulate the issues that are of importance to you and your project. An important part of our mission is therefore to reduce unreasonable or ill-considered contract texts, which unfortunately are common. Ill-considered wording can often lead to disputes later on in the contract and/or to the Contractor raising its tender.
As a Contractor, we regularly assist you in reviewing the AF components and contract documents to identify potential risks, which you should price or otherwise address in your tender. By combining legal and commercial understanding, we create the necessary conditions for you to secure the contract.
Consinuous support in projects
During the construction period, we often provide a sounding board for both Employers and Contractors by providing continuous legal advice. For example, we assess whether the Contractor is entitled to a time extension, the chances of success with alterations and additional works or hindrance claims, and how the contract should be interpreted in areas where the parties have divergent perceptions. If a dispute is imminent, we can advise you on how to proceed and how to secure evidence. If you wish, we can also handle the negotiations for you.
Construction disputes
We frequently represent Employers, Contractors and consultants in courts and arbitration tribunals in construction disputes. Many disputes that we handle are extensive and require not only knowledge of construction law but also a technical understanding. In these disputes, we leave nothing to chance.
Our team has successfully represented clients in disputes relating to major infrastructure projects, power plants, civil engineering contracts, hindrances/interferences, partnering agreements, consultant liability, etc.
